Judge Richard Leon of the United States District Court for the District of Columbia has remanded a case back to the FDA so that it can reconstitute the makeup of the Tobacco Products Scientific Advisory Committee. The Court found that the inital make up of the committee was improper and barred its initial "Menthol Report" which dealt with menthol in tobacco products.
I highlight this case because it is one of a very small number of Federal Advisory Committee Act cases that has occurred over the past years. In this case, the tobacco industry was successful in attacking the makeup of and then the actions of the committee after it had been established.
