To slightly modify your question, I would add, what do you do if you have actually taken the conservative path and informed the agency that they may have released info to you by accident, and they don't respond? In this case the DOD immediately responded. In one of my requests I got a document in the mail in response to a FOIA request that looked like it was still classified, and I fired an email off to the agency (State) asking "Did you just send me classified information," citing my reasons for suspecting as such. They never responded. How long do you have to wait before publishing before you can assume that they don't have a problem with it, if they don't answer?
