On Friday, Commissioner of the Securities and Exchange Commission, Mary Schapiro, wrote a letter to Congress stating that her agency will only use its new poorly worded exemption to withhold records as it was intended to be used and will not be broadened to exempt nearly every record the SEC receives. The Washington Post has more. According to CNN, the agency will issue regulations concerning the use of the new exemption. These regulations, which should be the subject of public comment, will be the actual proof of what the SEC intends to do with its new withholding powers.
Additionally, others weighed in on the story. The Wall Street Journal has this article, The Open Records Blog has this; and Josh Gerstein of Politico has this excellent roundup of the controversy and where it stands.
